CAT orders "Status Quo" on detachment order allegedly issued on behest of MLA in J&K

Jammu, Fen 28: In O.A./194/2025 (JAMMU)titled KABIR AHMED Vs SCHOOL EDUCATION DEPARTMENT after hearing CAT ordered as under:-

The grievance of the applicant as projected by the learned Sr. Counsel is that applicant, a Teacher was deployed as Assistant Warden in the year 2023 in Gujjar and Bakerwal Hostel (Boys) Kalakote, where about hundred tribal students are admitted and the deployment of the applicant was to be continued in the hostel till a permanent arrangement is made by the competent authority as per policy issued by the General Administrative Department.

It is further submitted by the learned Sr. Counsel that on the direction of MLA Kalakote-Sunderbani, the applicant has been illegally detached from the hostel with a direction to report to his original place of posting vide order dated 19.02.2025 issued by ZEO, Kalakote (Respondent No. 5), which is not only malafide on the face of it, having issued by an incompetent authority.

In this regard, learned Sr. Counsel has placed reliance on the judgement of Manmohan Lal Vs. State and others 1997 KLJ, 386.

Issue notices to respondents. Mr. Sudesh Magotra, learned A.A.G. appears and accepts notices on behalf of the respondents.

List on 08.04.2025.

Let reply be filed by the respondents by or on the next date of hearing with advance copy to learned counsel for the applicant.

Status quo as on today qua the applicant be maintained till the next date of hearing.
