Jammu, Apr 02: In C.P./267/2024 (JAMMU)In O.A./1027/2023 titled NEELAM SINGH Vs MR CHANDRAKER BHARTI, IAS PRINCIPAL SECRETARY, HOME DEPARTMENT, after hearing CAT ordered as under:-
The compliance report, despite umpteen opportunities granted earlier has not been filed in the matter.
Learned counsel for the petitioner stated that vide order dated 07.07.2021 passed by Inspector General of Police, Jammu (Respondent No. 3), the leave salary for a period of 300 days earned leave, along with admissible Dearness Allowance was sanctioned in favour of the petitioner, but for the last more than three years, despite direction the said amount of leave salary has not been paid to the petitioner which is causing hardship to him.
It appears that as per order dated 20.02.2024 passed in O.A. No. 1027 of 2023, the Respondents were directed to pass order within a period of four weeks, but even after lapse of one year, the order for release of leave salary of the petitioner has not been passed.
In these circumstances, we are left with no option but to attach the salary of Respondent No. 5 (Medical Superintendent Police Hospital, Jammu).
Accordingly, it is directed that salary of Respondent No. 5 shall remain attached till the compliance report is filed.
A copy of this order be furnished to concerned DDO for compliance.
