Jammu, march 13: In O.A./248/2025 (JAMMU) titled SHAHNAWAZ SHEIKH Vs SCHOOL EDUCATION DEPARTMENT after hearing CAT ordered as under:
Having heard learned counsel for the applicant, we issue notice to the respondents returnable by the next date of hearing
Mr. Sudesh Magotra, learned D.A.G. appears and accepts notice on behalf of the applicant. Respondents are directed to file reply by the next date of hearing on. learned counsel for applicant submitted that applicant is working at the present place of posting as on today.
As per the submission made by the applicant's counsel, the transfer order dated 06.03.2025 has been passed without taking into consideraton that the applicant is going to retire on 31.08.2025.
Even in terms of clause 17-20 of Transfer Policy for Employees of School Education Department which was introduced vide Annexure-'A' to Government order No. 103-JK(Edu)of 2023 dated: 24.04.2023 , "The employee(s) attaining the age of superannuation within six months, shall preferably be posted nearby his/her residence as far as practicable. Employee in the age group of 58 years and above shall not be posted in Zone-IV and V as far as practicable.
19. To the extent possible, single parent, divorcee, widow, female employees and an employee having specially abled children shall be posted conveniently. 20. Physically challenged employee(s) may be given convenient posting subject to the availability of post(s)."

In the meantime, the impugned Govt. Order No. 203-JK/(Edu.) of 2025 dated 06.03.2025 is stayed till the next date of hearing.
The applicant will be allowed to work at the present place of posting at ZEO Inderwal.
Applicant counsel is directed to remove the defects in the Original Application.
