Despite stoppage of salary of Comm/Secy, Govt not file reply? CAT to take coercive action in non compliance

Jammu, Dec 15: In T.A./8180/2021 (JAMMU) in SWP NO 701/2015 titled AKHIL GUPTA Vs GENERAL ADMINITRATIVE DEPARTMENT  after hearing CAT ordered as under:-

Reply has still not been filed by the respondents.

On perusal of file, it was shockingly revealed that vide order dated 09.11.2024, salary of respondent no. 1 i.e. Commissioner-cum-Secretary, General Administration Department, Jammu was stopped for not filing the reply, still the respondents have failed to file the reply after having availed several opportunities.

Mr. Sudesh Magotra, learned A.A.G. appearing on behalf of the respondents submitted that due to inter-Departmental communication the delay being caused is inevitable.

Mr. Magotra, promised to file the reply as early as possible.

In the interest of justice four weeks' time as a matter of last and final opportunity is granted to the respondent to file the reply, failing which the coercive action shall be taken against the Erring Officer, or it would be presumed that respondents have nothing to say and the decision would made ex-parte.

Mr. Hunar Gupta and Mr. Dewakar Sharma submitted that they would adopt the reply filed by General Administration Department.
