After hearing Parag's legal submissions, High Court stays 30% DMF amount imposed to Brick Kilns by Govt

Jammu, Dec 01: In WP(C) No. 2815/2024 CM No. 6862/2024 titled M/s Bhawani Brick Kiln  Vs UT of J&K & Ors. after hearing the legal submissions of Parag Sharma, Advocate, a bench of  HON’BLE MR. JUSTICE M A CHOWDHARY, JUDGE ORDERED as under:-

Petitioner though the medium of this petition has challenged a Notice dated 25.09.2024 issued by the respondent No. 3 – District Mineral Officer, Geology & Mining Department, Jammu, whereby all the Brick Kilns holders have been asked to deposit a District Mineral Foundation amount uniformly @ 30% as per Rule 11(2) of the J&K District Mineral Foundation (Composition, Contribution, Functioning, Funding and Trust) Rules 2017 and TSC @ 2% shall also be charged from PAN Card Holders and @ 20% from those not having PAN, asserting therein that the petitioner has been carrying out non- mining activity in terms of S.O. 138 dated 19.04.2021. 02.

Heard.

    "Issue notice to the respondents, returnable within four weeks, subject to filing of the requisites within a week’s time.

 List on 10.02.2025.

 Meanwhile, subject to objections and till next date of hearing before the Bench, the impugned notice dated 25.09.2024 qua petitioner is stayed.
