JAMMU, Sept 3: There are countless cases, which are waiting for their outcomes since years but are being delayed by unnecessary adjournments & not filling of replies by Govt Officers well in time.
It is also a fact that "Delay in Justice is denial of Justice" .
Now, with an intent to curb and decrease the pendency of five years plus old cases and to ensure equitable and rationalized distribution/allocation of oldest cases among the Judicial Officers, the Acting Chief Justice of J&K and Ladakh High Court Justice Tashi Rabstan has issued additional guidelines for adherence by the District Judiciary. Copy with CTN reads as under:-
However, it is also to mention here that listing of hundred number of cases in a bench for a particular day but picking of 30 to 40% due to available time & rest again goes to next long dates also causing delay in justice, otherwise only listing of limited number of cases, which could be heard in a day day & disposed on the fault of Govt or applicants or non appearance of advocates shall no doubts reduce the pendency's in particular court & so on shall reduce pendency's & streamline the system of early justice.
