JAMMU, Nov 07:Pertinent to mention here that a status Quo was passed by DB in the year 2014 on Gair Mumkin Khads but was ordered in Feb 2016 Govt to frame a State Water Policy within 02 months & till the policy is framed, status quo to be continued.
As usual Govt Bosses did not comply DB's orders following which contempt CPPIL 08 /2016 was filed but after seeking personal appearance of top bosses in High Court, immediately Govt filed State Water Policy as SRO-456 of 2017 dtd 25th Oct 2017 in High Court following which CPPIL was disposed off & as per DB's order dtd 2016 status quo on Gair Mumkin Khad Lands automatically goes.
But in SRO, Div com/DCs were designated as adjudicating officers to decide the issue of gair mumkin khad lands.
After continues publications by Cross Town News on facts of harassment by Revenue Officers some process started.
However, once upon a time Administrative Council headed by LG & CS, Advisor, Comm/Secretary as members passed a Decision No 17/1/2022 td 29th Jan 2022 by which DCs were ordered to decide the issue in 03 months but despite lapse of 20 months situation & progress except Samba district is debatable.
However, it is necessary to mention here that Anshul Garg, then DC Jammu questioned the knowledge & working of top Revenue Officers of J&K by quoting in his letter that "There was no ban & there is no ban on "Gair Mumkin Khad Lands" vide letter dtd 06.07.202, with copy to FCR but it has been observed that his clarifications have not been implemented till today.
This has caused multi thousand crore loss to JKUT Govt by way of stamp duty fee harassment to thousands of innocents of J&K.
Above all non compliance of LGs Administrative Councils Decision No 17/1/2022 dtd 29th Jan 2022 followed by GO No 18-JK(rev) of 2022 dtd 4th Feb 2022.
