High Court order for preservation of GPS locations/call detail records of Officers/ officials of ACB J&K

Jammu, Nov 01: In a hot case of trap, the Hon'ble High Court ordered for preservation of GPS locations and call detail records of Officers/ officials of A.C.B Rajouri and complainant including that of petitioner namely Rohit Sharma, the then Tehsildar Bahu.

On 21.10.2023, the Hon'ble high court at Jammu while hearing petition filed by Mr Rohit Sharma through Sr Advocate Sh. Sunil Sethi and Sh. Adv. Parimoksh Seth has directed the Central Bureau of Investigation (present investigating agency) for ensuring preservation of call detail records and G.P.S locations of members of Trap team and the then S.S.P, A.C.B Rajouri w.e.f 01.11.2022 (date of filing of complaint) to 15.11.2022 (14.11.2022 being date of Registration and execution of impugned F.I.R) including call detail records and G.P.S locations of accused petitioner (Sh Rohit Sharma) and complainant for the said period.

Pertinent to mention that Mr Rohit sharma had moved the Hon'ble high court and prayed that the impugned F.I.R No 02/ 2022 was registered by sleuths of A.C.B Rajouri in blatant violation of Government order regarding jurisdiction of Police Station of A.C.B.

Besides, it has been averred that the entire trap proceedings were conducted in a fake, dramatized and highly motivated manner by an officer of rank of Dy Sp and his associated team which is ample clear and evident in C.C.T.V footages which have already been provided to the Hon'ble High court by Sr. Adv Sunil Sethi in main petition No. 2788/ 2022 and is a part of court record.

It was prayed that in order to avoid miscarriage of justice, the Preservation of call detail records and G.P.S location is needed to be done as the same shall not be available after expiry of certain time period.

Pertinent to mention that the Government of UT of Jammu and Kashmir after noticing certain irregularities in the manner the impugned F.I.R was registered and the way trap proceedings were unfolded had already transferred the impugned F.I.R no 02/ 2022 from A.C.B Rajouri to Central Bureau of Investigation , Jammu Branch and reportedly investigation is under way.
