High Court orders to grant retrospective effect for regularization of services of petitioner,  orders failing to appear in court

Jammu, Sep 19: In CPSW No. 217/2012 titled Mohan Lal V/s Rakesh Gupta and others after hearing HON’BLE MRS. JUSTICE SINDHU SHARMA, JUDGE ORDERED as:-

01. Mr. Amit Gupta, learned AAG has filed an application seeking exemption of personal appearance on behalf of respondent No. 1, but the same is not on record.

02. Learned AAG for the respondents has provided a copy of the application, wherein, it is submitted that the respondent No. 2, Principal Conservator of Forests (HoFF), J&K, has filed compliance report informing that the Finance Department vide its U.O. dated 12.09.2023 has accorded concurrence for granting of retrospective effect for regularization of services of the petitioner and the matter has now been referred to General Administrative Department for approval of the competent authority.

03. It is further stated that on the directions of the Division Bench of this Court, the respondent No. 1 has been directed to remain present in person today i.e. on 18.09.2023, before the High Court at Srinagar.

04. For the reasons stated in the application, the same is allowed. The respondent No. 1 is exempted from personal appearance.

05. In view of the submissions made by the learned counsel for the respondents, two weeks’ further time is granted to the respondents to file compliance report for grant of retrospective effect for regularization of services of the petitioner, failing which, respondent No. 1 and 4 shall remain present on the next date of hearing.

06. Application is, accordingly, disposed of. 07. Registry to scan and attach the application with the file. 08. List on 09.10.2023. (
