Jammu, Sept 04: In WP(C) No. 2278/2023 titled A1 Asset Holding Ltd v/s UT of J&K & Ors after hearing HON’BLE MR. JUSTICE M A CHOWDHARY, JUDGE ORDERED as:-
Petitioner through the medium of this petition seeks direction in the form of Writ of Certiorari, seeking setting aside of the Notice No. Secy./JDA/PS/217-19 dated 26.06.2023, by virtue of which the Jammu Development Authority (in short the, “JDA”) has asked the petitioner to handover the possession of the land measuring 03 Kanals situated at Rail Head Complex, Jammu to the JDA within a period of thirty days from the date of issue of the said order, with further direction that in case, the lessee AI Assets Holding Ltd. fails to deliver possession of the premises to the lessor/Jammu Development Authority, the lessor/Jammu Development Authority shall have a right of re-entry upon the premises and to proceed as per norms.

Issue notice to the respondents, returnable within four weeks.

Meanwhile, subject to objections from the other side and till next date of hearing, operation of the impugned order dated 26.06.2023 is ordered to be kept in abeyance.
