Jammu, Sept 02: In CPSW No. 7/2004 titled Harbhajan Singh & Ors. Vs Madho Lal & Ors. HON’BLE MR. JUSTICE VINOD CHATTERJI KOUL, JUDGE ORDERED as:-
This Court vide order dated 11.08.2023 granted one week’s further time to the respondents to comply with the order dated 07.06.2023 and to file compliance report of order dated 30.05.2019 to the extent it pertains to Petitioner No. 2, failing which, Commissioner Secretary, GAD shall remain present in person before the Court on the next date of hearing.
Subsequently, on 25.08.2023, the matter could not be heard due to non availability of Mr. Raman Sharma, AAG and the same was adjourned and listed for today i.e. on 01.09.2023.
Since, there is no representation on behalf of the respondents today, it has been observed by the Court that neither the order dated 07.06.2023 has been complied with by the respondents nor compliance report in terms of the previous order has been filed.
In this situation, this Court is left with no option but to issue bailable warrant against Commissioner Secretary, GAD to the tune of Rs. 25,000/-, for securing his presence before the Court on the next date of hearing, to be executed through Senior Superintendent of Police (SSP), concerned. List on 11.10.2023
