High Court to take corrective actions in non compliance as question arises on different stand of Govt in appointment as AEE?

Jammu, Jan 11: In CPSW No. 109/2010 in SWP No. 1867/2002 titled Ashok Kumar Pargotra V/s Umang Narula  after hearin HON’BLE MR. JUSTICE JAVED IQBAL WANI, JUDGE ORDERED as under:-

1. Mr. Raman Sharma, learned AAG appearing for the respondent/contemnor would fairly submit that compliance report filed, seemingly, is in conflict with the record available, in particular, the engagement order of the petitioner as Incharge Assistant Executive Engineer ordered vide order dated 08.01.2002, which manifestly provides for the engagement of the petitioner against an available vacancy in contradiction to the stand taken in the compliance report that no vacancy was available at that relevant point of time.

2. Be that as it may, learned counsel for the respondent seeks and is granted three weeks’ time as last and final opportunity to report compliance of the judgment, failing which, the non-compliance shall entail taking of coercive measures.
