J&K: Court awards life term Imprisonment to 5 in murder case

UDHAMPUR, Dec 26: The Court of Principal Sessions Judge, Udhampur, Virinder Singh Bhou, has awarded rigorous imprisonment for life to five persons in the Chenani murder case arising out of FIR Number 135/2020 registered at Police Station Chenani.

The convicts-Pahar Singh alias Parshotam, Radha Devi, Harish Singh, Anil Singh and Arnood Singh alias Rajesh-were tried in Sessions Case (Murder) Number 13/2021 and found guilty of serious offences including murder under Section 302 IPC and attempt to murder under Section 307 IPC.

According to the prosecution, the crime was the result of an illicit relationship between accused Pahar Singh and Radha Devi, which was opposed by the deceased Vijay Kumar brother-in-law of Radha Devi and the complainant Gurdeep Singh, the husband of Radha Devi.

The court recorded that on the intervening night of December 12 and 13, 2020, at around 1 am, the accused persons went to the house of Gurdeep Singh, broke open the door and attacked Vijay Kumar using sticks, a toka and an iron pipe. Gurdeep Singh was also assaulted during the incident and narrowly survived.

Vijay Kumar later succumbed to the injuries inflicted upon him. After appreciating the evidence on record, the court held that the prosecution had proved beyond reasonable doubt the charge of murder of Vijay Kumar and attempt to murder Gurdeep Singh.

The court further recorded that accused Pahar Singh destroyed evidence, attracting Section 201 IPC. Accused Anil Singh was found to be in possession and use of a toka, leading to his conviction under Section 4/25 of the Arms Act.

Accordingly, the court sentenced all the convicts to life imprisonment under Section 302 IPC with a fine of Rs 10,000 each.

They were also awarded 10 years’ rigorous imprisonment under Section 307 IPC with a fine of Rs 5,000 each, and seven years’ rigorous imprisonment under Section 458 IPC with a fine of Rs 5,000 each, besides other sentences and fines under Sections 147, 148 and 323 IPC.

All the sentences were directed to run concurrently. T
