Jammu, April 15: In O.A./424/2025 titled RUQSHINDA KOSSER Vs SCHOOL EDUCATION DEPARTMENT after hearing CAT ordered as under:-
Mr. Arshad Majid Malik, ld. counsel for the applicant submitted that the applicant in the present O.A. is aggrieved of impugned Govt. Order No. 288-JK(Edu) of 2025 dated 10.04.2025 (S.No. 186) issued by respondent no. 1 by virtue of which the applicant who is at verge of retirement, as 09 months service is left and is retiring on 02.02.2026, has been transferred from the post of ZEPO of Rajouri to High School Chowdhary Nar, which is a far flung area without taking into consideration the medical disability of the applicant.
2. Learned counsel for the applicant prays for interim relief that the operation of impugned Govt. Order No. 288-JK(Edu) of 2025 dated 10.04.2025 may kindly be stayed in the interest of justice.
3. Issue notice to the respondents. Mr. Sudesh Magotra, ld. AAG appears and accepts notices on behalf of the respondents. 4. Ld. AAG vehemently opposed the prayer of learned counsel for the applicant.
5. Heard learned counsel for the parties.
6. In view of the submission made by learned counsel for the applicant, we are of the view that the applicant has made out a, prima facie, case for interim relief.
7. Accordingly, as an interim measure the Govt. Order No. 288-JK(Edu) of 2025 dated 10.04.2025 qua the applicant is stayed till the next date of hearing.
8. Till then, the applicant is allowed to continue her work at her present place of posting i.e., ZEPO, Rajouri.
