Ranchi , Apr 06: The Ld. Court of Special Judge for CBI Cases, Ranchi sentenced five accused including Md. Illiyas Hussain, then Minister of Road Construction Department, Government of Bihar; Md. Shahabuddin Baig, Ashok Agrawal, Pawan Kumar Agrawal and Vijay Kumar Sinha Rigorous Imprisonment of three years with fine of Rs 32 lakh each in a Bitumen Scam Case.
CBI had registered the instant case on 06.05.1997, on the orders of Hon’ble High Court of Patna vide its order dated 20.02.1997 taking over the case, initially registered on 07.10.1996 at Hazaribagh Sadar Police Station, against Md. Illiyas Hussain and others in the Bitumen Scam Case.
It was alleged that main accused Md. Illiyas Hussain, then Minister of Road Construction Department, Government of Bihar had entered into criminal conspiracy with other accused persons and committed crime u/s 120-B, 407, 409, 420, 468, 471 of IPC and section 13(2) r/w 13 (1) (d) of PC Act.
The case related to transportation of Bulk Bitumen from Haldia to RCD Hazaribagh via Barauni for road construction. It was alleged that no such bitumen was transported for the purpose.
Transporter allegedly uplifted bitumen from Haldia and sold it in the open market at Kolkata and wrongfully claimed transportation charges whereas no bitumen was transported at all.
After investigation, CBI filed chargesheet on 31.03.2001 in which it was revealed that Md. Iliyas Hussain, the then Minister of Road Construction Department, Govt. of Bihar had entered criminal conspiracy with other co- accused and committed the offence u/s 120B, 407, 409, 420, 468, 471 of IPC and Sec. 13(2) r/w 13(1)(d) of PC Act, 1988 for the misappropriation of the bitumen which was purchased by the Bihar Government for road construction to the tune of Rs. 27.6 lakh.
Thus, a wrongful loss of Rs. 27.6 lakh was caused to the Bihar Govt. with corresponding wrongful gain to accused persons. The Court after trial, found accused guilty and sentence them accordingly.
