J&K: CAT directs Govt to maintain status quo & not to make any appointment to post of Stipendiary Senior Resident Doctor

Jammu, March 16: In O.A./208/2025 titled DR TANIYA ZAHOOR Vs HEALTH AND MEDICAL EDUCATION DEPARTMENT after hearing CAT ordered as under:-

Learned counsel for the applicant submits that although a copy of the petition has been duly served to the learned counsel for the respondents, no one has appeared on their behalf. Learned counsel further submits that the applicant has challenged the impugned order dated 08-03-2025, which disregards the merit-based selection process and has unjustly deprived the petitioner of the opportunity she rightfully deserves.

She further states that the applicant is a meritorious candidate, having secured 488 marks in the PG course, whereas the selected candidate, Dr. Hakem Shakir Ali, has obtained only 420 marks.

He contends that the applicant is more meritorious than the selected candidate and that the selection of Dr. Hakem Shakir Ali is arbitrary and without merit.

Learned counsel for the applicant further submits that the applicant will be filing an application for the impediment of the private respondent today itself. Prayer is allowed. The applicant is granted liberty to file the necessary application to implead the selected candidate as party respondent.

The respondents are directed to maintain status quo and not to make any appointment in terms of the impugned order dated 08-03-2025 with regard to the post of Stipendiary Senior Resident Doctor at SKIIMS Soura.

List this matter on 24-03-2025 for extension of Interim Relief.

The respondents are directed to file their reply on extension of the interim relief within 10 days from today.
