Jammu, March 11: In CCP(S) No. 130/2024 IN SWP No. 1669/2016 titled Shashi Paul and Ors. V/s Shaleen Kabra Financial Commissioner PHE Deptt. and Ors after hearing HON’BLE MRS. JUSTICE MOKSHA KHAJURIA KAZMI, JUDGE ORDERED as under:-
The instant contempt petition has been preferred alleging noncompliance and willful disobedience of order/judgment dated 11.12.2023 passed by this Court in SWP No. 1669/2016 by virtue of which the writ petition filed by the petitioners was disposed of with the following directions.
“In view of the categoric admission by the respondents that the petitioners are working as casual labourers in lieu of the land donated by them or their parents, the present petition is disposed of by directing the respondents to pay the salary/wages to the petitioners regularly without any fail. In the event, the petitioners find that the respondents are still in arrears, in respect of unpaid wages, the petitioners shall make a detailed representation in respect of the period and amount regarding which the arrears are payable by the respondents to the petitioners.
In the event any representation is made by the petitioners, the respondent No. 4 shall ensure that whole of the arrears which are due to the petitioners are paid to them in accordance with rules, expeditiously preferably within a period of three months.’’
Status report stands filed by the respondents and it stated that the case of the petitioners is under active consideration and has been forwarded to the Administrative Department vide computer e-file No. 7487679 for necessary instructions.
It is further stated that and as when the instructions would be imparted from the higher authorities, the compliance report would be filed. This is very unfortunate that such kind of status report has been filed before this Court on 10.09.2024 i.e. after almost 11 months of passing of the order dated 11.12.2023.
Last and final opportunity of three weeks’ is granted to the learned counsel for the respondents to file compliance report strictly in conformity with the order passed by the Court dated 11.12.2023, failing which, respondent Nos. 1, 2 & 4 are directed to appear in person or through virtual mode on the next date of hearing.
