CAT questions premature transfer in J&K? Asks to file whether is in consonance with transfer policy

Jammu, Feb 15: In O.A./132/2025 (JAMMU) titled AMARDEEP SINGH Vs FOREST DEPARTMENT  after hearing CAT ordered as under:-

1. Heard the learned counsel for the applicant.

2. The grievance of the applicant, as projected by learned counsel for the applicant, is that the applicant has been transferred prematurely from Lakhanpur Check Post, Kathua Forest Division to Agrostology Range, Rajouri in violation of transfer policy dated 28.07.2010 as well as SRO 307 dated 11.07.2018 in order to adjust private Respondent No. 5 herein.

3. Issue notice to respondents. Mr. Sudesh Magotra, learned A.A.G. and Mr. Jagpaul Singh, learned counsel appear and accept notices on behalf of Respondents No. 1 to 4 and Respondent No. 5 respectively.

4. Learned A.A.G. submitted that transfer of the applicant along with some other officers has been done in the interest of administration and the transfer order has been passed by the competent authority.

5. From the perusal of the transfer order in question, ex-facie, it appears that applicant has been prematurely transferred from Lakhanpur Check Post, Kathua Forest Division to Agrostology Range, Rajouri within a period of one year, in violation of the transfer policy.

6. Learned A.A.G. shall file a short reply to the O.A. specifying therein as to whether the transfer order of the applicant is in consonance with transfer policy dated 28.07.2010 as well as SRO 307 dated 11.07.2018.

7. List on 19.02.2025.

8. In the meanwhile, if the applicant has not already been relieved from Lakhanpur Check Post, Kathua Forest Division, he shall be permitted to continue working as such, till the next date of hearing.
