Jammu, Feb 12: In WP(C) No.262/2025 CM No.511/2025 titled Chenab Valley Public Hr. Secondary School V/s J&K Committee for Fixation and Regulation of Fee of Private Schools, J&K(FFRC), Jammu and others after hearing a bench of HON’BLE THE CHIEF JUSTICE HON’BLE MR. JUSTICE MA CHOWDHARY, JUDGE ORDERED as:-
1. It is submitted by Mr. Amit Gupta, learned counsel appearing on behalf of the petitioner that in an identical and similar petition being WP(C) No.897/2023 titled “St. Francis Kids World Mendhar Poonch vs. Jammu and Kashmir Committee for Fixation and Regulation of Fee of Private Schools and others”, this Court while issuing notice to the other side, vide order dated 12.04.2023, has granted interim relief.
He seeks the same relief as has been granted in the above similar petition. His statement is taken on record.
2. Be that as it may, issue notice to the other side. Requisites be furnished within one week.
3. List along with WP(C) No.940/2021.
4. Meanwhile, in order to maintain parity, the operation of impugned order No.153-FFRC(FF) of 2022 dated 10.02.2022 shall remain stayed. It is, however, made clear that notwithstanding the stay of impugned order, petitioner’s School shall charge tuition fee and annual fee only as is proposed by the petitioner for the year 2025-26.
