J&K: High Court seeks personal appearance of DC & ors, if fail to file compliance in 10 days

Jammu, Feb 11: In CPOWP No. 258/2018 in OWP No. 1295/2015 titled Sheela Devi and others vs Sanjeev Verma, D. C. Jammu after hearing a bench of HON’BLE MR. JUSTICE RAJNESH OSWAL, JUDGE ORDERED as:-

1. Vide order dated 18.12.2017, Divisional Commissioner, Jammu was directed to ensure formal acquisition of the land in question for the purpose of payment of compensation to the original land owners including the petitioners.

2. Learned counsel for the respondents submits that the compliance report has been filed by the respondents, however, the same is not on record.

3. Learned counsel for the respondents has produced a copy of the compliance report for perusal of this Court.

The same is taken on record.

4. A perusal of the compliance report reveals that the respondents have stated that the land on which community hall has been constructed falls within the area of municipality and the same stands transferred to the municipality.

5. Area in question was included in the municipal limits vide order dated 11.06.2018 i.e. prior to the judgment passed by this Court.

6. In view of this, the respondents are granted 10 days’ time to comply with the judgment in its letter and spirit, failing which, they shall remain present in person before the Court on the next date of hearing.

7. List on 25.02.2025.
