CAT recalls order by virtue of which salary of DG IMPARD & Joint Director was stopped

Jammu, August 3: In M.A./657/2024 (JAMMU) In T.A./3959/2020 titled RURAL DEVELOPMENT UT OF J&K Vs ASHOK KUMAR BHAT afrer hearing CAT Bench ordered as under:-

Miscellaneous Application No. 657 of 2024 M.A. No. 657 of 2024 has been filed by Mr. Sudesh Magotra, learned A.A.G. on behalf of respondents for recalling/modifying of order dated 12.07.2024 passed by this Court in T.A. No. 3959 of 2020.

Mr. Sudesh Magotra, learned A.A.G. submitted that reply has been filed by the respondents in this case.

Accordingly, the order dated 12.07.2024 is recalled, by virtue of which the salary of Respondent No. 2 and 3 i.e. Director General, J&K Institute of Management, Public Administration & Rural Development and Joint Director (IMPARD), J&K Institute of Management, Public Administration & Rural Development was stopped and enquiry was directed to be initiated against them as the reply was not filed in this case despite availing various opportunities by the respondents.

The D.D.O. concerned is directed to release the salary of salary of Respondent No. 2 and 3 i.e. Director General, J&K Institute of Management, Public Administration & Rural Development and Joint Director(IMPARD), J&K Institute of Management, Public Administration & Rural Development with immediate effect.

In view of the above directions the Miscellaneous Application is disposed of.

T.A. No. 3959 of 2020 Mr. Sudesh Magotra, learned A.A.G. submitted that J&K Institute of Management, Public Administration & Rural Development (IMPARD) is not a department, rather it is a society and therefore this Tribunal has no jurisdiction to adjudicate case pertaining to such a society.

Accordingly, in view of the above submission as made by the respondents counsel, this Transferred Application is transferred back to the Hon'ble High Court of Jammu and Kashmir, Jammu as its jurisdiciton does not lie within the ambit of Central Administrative Tribunal.

Registry is directed to transfer this Transferred Application along with all its records to the Hon'ble High Court of Jammu and Kashmir, Jammu.
