CAT questions "Super Powers" of J&K Officer?  Stops salary of Director  & orders enquiry

Jammu, July 15: A Judicial Member of Central Administrative Tribunal Rajinder Singh Dogra took serious note of the respondents for not filing response in a petition filed by Raman Gupta, wherein vide orders dated 27.02.2024, 02.05.2024 and 13.06.2024, respondents were granted last and final opportunity to file their written statement, and in case the same is not filed the Erring Officer/Official was directed to remain present before the Court with the explanation as to why the reply was not filed till date. CAT further observed that the matter was filed way back in the year 2017 before the Hon'ble High Court of Jammu and Kashmir as SWP No. 1415/2017 and vide order dated 06.12.2021 it was transferred to this Tribunal for further jurisdiction, and the respondents were granted time to file the reply in the matter and directed D.D.O to ensure that the salary of Director, Forest Protection Force, Jammu, be stopped with immediate effect till further orders.

CAT further directed Commissioner/Secretary to Government, Forest Department, J&K is directed to initiate an enquiry against Director, Forest Protection Force, Jammu, as to why, neither the reply was filed nor he was present before the Court despite clear directions passed vide orders dated 27.02.2024, 02.05.2024 and 13.06.2024, and thereafter, take strict action against the Officer for not complying the orders of the Court.

The action taken report will be submitted along with the written statement in the present case by the next date of hearing.
